a las medidas de evitamiento, adquiriendo relevancia la discrecionalidad de cada juez22.
Como ya sucedió (Corte Suprema de Justicia de la República, Consulta del exp. N.°
10541–2019, Puno), el aparato judicial podría considerar que las reglas que restringen las
medidas para un delito comprenden supuestos que no deberían —son supraincluyentes
(Schauer, 1991/2004), al mediar una laguna axiológica (Atienza, 2017)—,
correspondiendo —vía ponderación— desbloquear la alternación o sustitución penal.
Para armonizar el quantum normativo de la prognosis de pena con las figuras que
evitan la cárcel antes tendría que uniformizarse las reglas de aplicación de estas últimas,
extendiendo su alcance a todos los delitos y bajo un marco penológico inmutable, lo que
es, sin embargo, poco realista.
Sin perjuicio de lo anterior, al haber el umbral penológico peruano alcanzado
autonomía, debe defenderse su respeto de forma independiente a la cláusula de
proporcionalidad y, siguiendo al Derecho Internacional23 y la política constitucional
nacional24, buscar su modificación siempre para elevar el muro a sortear si se pretende
hacer uso de la prisión sin condena, paliar los efectos nocivos25 y dar mayor espacio a
otro tipo de figuras.
Es pertinente recordar que algunas de las medidas más eficaces para reducir las
cifras carcelarias pasan por limitar los supuestos en que se satisface el fumus boni iuris
de la prisión preventiva, sea a través del establecimiento de un catálogo de delitos
numerus clausus fuera de los cuales no procede aplicarla y/o mediante el endurecimiento
de la pena —probable— a partir de la que está es procedente (Gascón, 2010).
En consecuencia, resulta previsible que el rigor de la prognosis de pena y de las
medidas de evitamiento de la cárcel se torne inversamente proporcional al despliegue de
la prisión preventiva, por lo que, con su modificatoria se puede fomentar el desuso de la
